Terms of service

These Terms of Service ("Terms") are a binding agreement between you and Direct Brothers, Inc., a Pennsylvania corporation doing business as Pottstown Army Navy ("Pottstown Army Navy," "we," "us," or "our"), 229 E High St, Pottstown, PA 19464. They govern your use of pottstownarmynavy.com (the "Site") and every purchase you make from us online, by phone, or through an invoice we send you.

Please read Section 16 carefully. It requires most disputes to be resolved through individual arbitration, waives class actions and jury trials, and explains how to opt out.

By using the Site or placing an order, you agree to these Terms and to our Return and Refund Policy, Shipping Policy, and Privacy Policy, which are part of these Terms. If you do not agree, please do not use the Site or place an order.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Some items, including knives, cutting tools, and lasers, are sold only to adults. We may cancel any order we reasonably believe was placed by or for a minor.

2. About our merchandise

Genuine surplus, vintage, and collectible items. Many items we sell are genuine military surplus, new-old-stock, used, or vintage goods. They may be decades old and were made to the government specifications of their era, not to current consumer product standards. They may show wear, storage marks, odors, fading, residue or protective powder, repairs, or markings. We have not tested or certified them for any current safety standard.

Descriptions. Dates, countries of origin, makers, and history in our listings reflect our good-faith research based on markings and known references. They are our opinion, not a guarantee of provenance, rarity, or value. Where we carry several identical units, photos may show a representative example. Colors vary by screen.

Sizing. Military items use the sizing system of the issuing service and era, which may differ from modern civilian sizing.

New merchandise. New items are described using manufacturer information. Any manufacturer warranty is provided by the manufacturer, not by us.

Reproductions. Items or options labeled "Repro" or "Reproduction" are modern reproductions, not original military issue.

3. Intended use and product safety

Many items are sold for collecting, display, education, historical reenactment, or general outdoor use. They are not certified protective, medical, or life-safety equipment. In particular:

  • Gas masks, respirators, and filters are sold as collectibles for display only. They are not certified to protect against any chemical, biological, smoke, dust, or other hazard. Filters may be expired or ineffective, and some vintage filters may contain hazardous materials, including asbestos. Do not wear them for protection, and do not open, breathe through, or use any filter. Dispose of filters according to local regulations.
  • Medical and first aid items, including bandages, dressings, medical sets, and tourniquets, may be expired or non-sterile and are sold for collecting, training, or display, not for treating injuries. Always seek professional medical care.
  • Helmets, goggles, gloves, armor components, and similar gear are not certified for ballistic, impact, eye, or safety protection unless a new item is expressly labeled as certified by its manufacturer.
  • Knives, entrenching tools, and other cutting tools are sharp and can cause serious injury. They are sold to adults only.
  • Stoves, fuel, lighting, flashlights, and lasers can cause burns, fire, or eye injury. Never point a laser at a person, vehicle, or aircraft; doing so can be a federal crime.
  • Canteens, cups, mess kits, and other vintage cookware may not meet current food-contact standards. Clean them thoroughly and use them at your own discretion.
  • Holsters, pouches, and other accessories are accessories only. We do not sell firearms or ammunition through the Site.

You are responsible for inspecting each item before use and for using it safely. To the fullest extent permitted by law, you assume all risks arising from the use, misuse, modification, or resale of any item.

Laws on knives, lasers, military uniforms and insignia, historical symbols, and other items vary by location. You are responsible for making sure you may lawfully buy, own, use, carry, and transport each item where you live. Federal law restricts wearing U.S. military uniforms, insignia, and medals in certain ways; you are responsible for any use you make of them. We may refuse or cancel any order we believe would violate the law.

5. Historical items

Some items carry insignia, markings, or symbols of historical governments, armies, or movements, including some associated with war or oppression. We offer them only for historical, educational, and collecting purposes. Offering them is not an endorsement of any ideology. You agree not to use any item to harass, threaten, or intimidate anyone.

6. Shipping area and export

We ship only to addresses in the United States. Some military items may be subject to U.S. export control laws, including the International Traffic in Arms Regulations and the Export Administration Regulations, and to U.S. sanctions. You agree not to export, re-export, or transfer any item in violation of those laws or to any person or place restricted by them. We may refuse orders that we believe raise export or sanctions concerns.

7. Orders, pricing, and availability

Your order is an offer to buy. Our order confirmation email confirms we received it; it is not acceptance. We accept your order when we ship it or mark it ready for pickup.

Our online and in-store inventory are shared. Because many items are one of a kind, an item may sell in our store before your online order is processed. If that happens, we will cancel that item and refund you in full.

We may limit quantities and may refuse or cancel any order, including for suspected fraud, errors in price or description, or unavailability. If we cancel after you have paid, we will refund the amount paid for the canceled items. Prices are in U.S. dollars and may change at any time. Sales tax is added where required. If an item is listed at an incorrect price, we may cancel the order even after confirmation.

8. Payment and charges

You authorize us and our payment processors to charge your selected payment method for the order total, including taxes and shipping and handling. The full order total, including shipping and handling, is shown at checkout before you pay. Payments are processed by third parties such as Shopify Payments, Shop Pay, PayPal, Apple Pay, and Google Pay; we do not store full card numbers. Shop Pay Installments are provided by a third-party lender under that lender's own terms.

9. Shipping, pickup, title, and risk of loss

Shipping methods, charges, and timing are described in our Shipping Policy. Delivery dates are estimates, not guarantees. Title to items and risk of loss pass to you when we deliver the package to the carrier, or when you collect a pickup order. We will still help with carrier claims for lost or damaged packages as described in our Return and Refund Policy. Pickup orders not collected within 30 days may be canceled and refunded.

10. Returns, final sale, and our arrives-as-described commitment

Returns are governed by our Return and Refund Policy. In summary: genuine surplus, Vault, and collectible items are final sale; new merchandise and items labeled "Repro" may be returned within 15 days of delivery if unused, with tags attached, in original packaging.

If an item arrives damaged, is the wrong item or size, or is in noticeably worse condition than described, contact us within 3 days of delivery with your order number and photos. We will, at our option, replace the item, issue store credit, or refund the purchase price. This is a customer-service commitment, not a warranty, and it is your sole and exclusive remedy for any item that is damaged, incorrect, or not as described.

11. Contact us before disputing a charge

Please contact us before filing a dispute with your bank or card issuer; we resolve most problems quickly. If you dispute a charge for an order that was delivered as described, we may provide your card issuer or payment processor with our order records, including the final-sale notices shown before purchase, delivery confirmation, and our communications with you, and we may decline future orders.

12. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED IN SECTION 10, ALL ITEMS ARE SOLD "AS IS" AND "WITH ALL FAULTS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NO STATEMENT BY OUR STAFF, ORAL OR WRITTEN, CREATES A WARRANTY. TO THE EXTENT ANY PRODUCT DESCRIPTION IS FOUND TO BE A WARRANTY, YOUR SOLE AND EXCLUSIVE REMEDY IS THE REMEDY IN SECTION 10. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." SOME STATES DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE SITE, ANY ITEM, OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO AN ORDER OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ITEM OR ITEMS GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

14. Indemnification

You agree to defend, indemnify, and hold harmless Direct Brothers, Inc. and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use, misuse, modification, resale, transport, or export of any item; your violation of these Terms or any law; or any content you submit.

15. Time limit to bring claims

To the extent permitted by law, any claim arising out of or related to the Site, an order, or these Terms must be filed within one year after the claim arises, or it is permanently barred.

16. Dispute resolution and arbitration

Informal resolution first. Before starting arbitration or a court case, you agree to email PottstownArmyNavy@gmail.com with your name, order number, a description of the problem, and what you are asking for. We will try in good faith to resolve it within 30 days.

Binding individual arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or related to the Site, any item, any order, or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitrator decides all issues, including the scope and enforceability of this section, except as stated below. Hearings may take place by video, phone, or written submissions, or in person in Montgomery County, Pennsylvania, or the county where you live. Fees are governed by the AAA Consumer Arbitration Rules.

Exceptions. Either party may bring an individual claim in small claims court (in Pennsylvania, a Magisterial District Court) if it qualifies. Either party may seek a court order to stop misuse of its intellectual property.

Class action and jury waiver. YOU AND WE MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, AND YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this class waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.

Opt out. You may opt out of this arbitration agreement by emailing PottstownArmyNavy@gmail.com within 30 days after you first accept these Terms, with your name, address, order number if any, and a statement that you opt out. Opting out does not affect any other part of these Terms.

17. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 16. Any claim not subject to arbitration must be brought exclusively in the Court of Common Pleas of Montgomery County, Pennsylvania, or the U.S. District Court for the Eastern District of Pennsylvania, and you consent to those courts' jurisdiction.

18. Use of the Site

You agree not to misuse the Site, including by scraping or copying content for commercial use, interfering with its operation, attempting unauthorized access, placing fraudulent orders, or using it for any unlawful purpose. If you create an account, keep your password secure; you are responsible for activity under your account. We may suspend access for any violation.

19. Intellectual property

The Site's content, including product photos, descriptions, text, logos, and design, belongs to us or our licensors and is protected by copyright and other laws. You may not copy, reproduce, or reuse it for commercial purposes without our written permission. Other brand names and trademarks belong to their owners. Military names, insignia, and terms are used only to describe the history of items and do not imply endorsement by the U.S. Department of Defense, any military branch, or any government.

20. Reviews and submissions

If you submit reviews, photos, questions, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce it in connection with our business. You confirm the content is yours to share and is lawful. We may remove any content at our discretion.

The Site may link to or use third-party services, such as payment processors, shipping carriers, Google, and social media. We are not responsible for their content, policies, or practices.

22. Privacy and electronic communications

Our Privacy Policy explains how we handle personal information. By using the Site, you consent to receive communications from us electronically, including order confirmations and notices, and agree that electronic communications satisfy any legal requirement that a communication be in writing.

23. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, including weather, natural disasters, carrier delays, power or internet outages, labor disputes, government action, or public health emergencies.

24. Changes to these Terms

We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes apply to orders placed after they are posted. Each order is governed by the Terms in effect when it was placed.

25. General

These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site and your purchases. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or transfer of our business. Provisions that by their nature should survive, including Sections 3 and 12 through 17, survive. Headings are for convenience only, and "including" means "including without limitation."
